Terms of Service

1. Acceptance of Terms

By accessing or using Drawfetti ("the Service"), available at drawfetti.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

Drawfetti is developed and operated by AdRific Oy (Business ID: 2811204-7, VAT ID: FI28112047), a company registered in Finland.

2. Description of Service

Drawfetti is a SaaS platform that connects to your Facebook Pages to help you run fair, transparent giveaway draws from post comments. The Service includes features such as comment fetching, filtering, random winner selection, and shareable results pages.

3. Account Requirements

  • You must have a valid Facebook account to use the Service
  • You must be at least 18 years old or the age of majority in your jurisdiction
  • You must be an authorized administrator or manager of the Facebook Pages you connect to the Service
  • You are responsible for maintaining the security of your account

4. Acceptable Use

You agree to:

  • Use the Service only for lawful purposes
  • Comply with all applicable laws regarding giveaways, contests, and promotions in your jurisdiction
  • Not manipulate or rig draws in any way
  • Not use the Service to spam, harass, or deceive others
  • Not attempt to access data from pages or accounts you do not manage
  • Not reverse engineer, decompile, or attempt to extract source code from the Service
  • Comply with Facebook's terms of service and community guidelines

5. Subscriptions & Payments

Drawfetti offers a Free plan and a paid Pro plan. Our current pricing:

  • Free: No cost, up to 200 comments per post
  • Pro Monthly: 9.99 €/$ per month
  • Pro Annual: 99 €/$ per year (save ~17%)

For paid subscriptions:

  • All payments are processed by Paddle.com ("Paddle"), who acts as our Merchant of Record. This means Paddle is the legal seller of the subscription and handles all billing, payment processing, invoicing, sales tax, and VAT compliance on our behalf
  • By purchasing a subscription, you agree to Paddle's Terms of Service and Privacy Policy in addition to these Terms
  • Paddle will charge your payment method and issue you invoices/receipts directly. All invoices will come from Paddle, not from AdRific Oy
  • Prices displayed may be exclusive of applicable taxes. Paddle will calculate and collect any applicable sales tax, VAT, or GST based on your location at checkout
  • Subscriptions are billed monthly or annually, depending on your chosen plan
  • You may cancel your subscription at any time from your account settings; access continues until the end of the current billing period
  • Refunds are available within 7 days (monthly) or 14 days (annual) of purchase — see our full Refund Policy
  • We reserve the right to change pricing with 30 days' notice

6. Facebook Data

The Service accesses your Facebook data through the Meta Graph API. By using the Service, you:

  • Grant us permission to access your managed Pages, posts, and comments as authorized through the Facebook OAuth flow
  • Acknowledge that the availability of our Service depends on Meta's API availability and policies
  • Understand that changes to Meta's API or policies may affect the Service's functionality
  • Can revoke access at any time through your Facebook Settings → Apps and Websites

7. Draw Results & Fairness

Drawfetti uses cryptographic random number generation to ensure fair winner selection. Each draw produces a verifiable seed that can be audited. However:

  • We do not guarantee that draws comply with local contest/giveaway laws — it is your responsibility to ensure legal compliance
  • We are not responsible for any disputes arising from draw results
  • Shareable results pages are public — do not share them if you require privacy

8. Intellectual Property

The Service, including its design, code, logos, and content, is owned by AdRific Oy and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our written permission.

9. Limitation of Liability

To the maximum extent permitted by law, Drawfetti and AdRific Oy shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

11. Termination

We may suspend or terminate your access to the Service at any time, with or without cause, with or without notice. Upon termination, your right to use the Service ceases immediately. You may also delete your account at any time.

12. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated by updating the "Last updated" date and, where appropriate, notifying you via email. Continued use of the Service after changes constitutes acceptance of the new Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to its conflict of law provisions. For payment-related disputes, Paddle's terms and dispute resolution process may also apply.
